11th Cir. The mere recordation of fees incurred by a home mortgage lender on its internal records, without any attempt to collect these fees from the debtor or estate or to modify the mortgage, is not an "act" in violation of § 362(a)(3). Nor is such an event a violation of § 362(a)(5). A mere potentiality of future liability reasonably cannot be considered the `creation' of a new and enlarged lien. The debtors' request for an injunction against the lender attempting to collect the subject fees post-discharge is not ripe.
