Although
a bankruptcy court presiding over a Chapter 7 bankruptcy case
lacks lacks in rem jurisdiction over property acquired
postpetition from a third party loan to the debtors, the court
nevertheless has jurisdiction to review and order disgorgement
of any payment made to an attorney for representing a debtor.
The court did not err in disallowing payment of, and ordering
disgorgement of, postpetition fees paid to the debtor's
attorney from settlement funds. |
